I.YOUR ACCEPTANCE OF TERMS & CONDITION:
Thank you for using Khanawale. These Terms of Service (the "Terms") explain your rights and responsibilities when using the Khanawale website at www.Khanawale.com (the "Site") and any related mobile apps or software (together, the "Khanawale Platform"), including services like browsing information now or in the future.

These Terms apply to all Khanawale users, including those managing restaurant listings on the "restaurant business page."

Please read these Terms carefully. By using the Khanawale Platform, you agree to follow these Terms and enter into a legal agreement with Khanawale (NK E-COM (OPC) PVT LTD). If you don’t agree to the Terms, you cannot use the services. Your use of the Khanawale Platform is at your own risk, including the chance of seeing inappropriate or unwanted content.

To use the Services, you must agree to these Terms. You can agree by:

• Clicking to accept the Terms when prompted by Khanawale, or
• Using the Services, which will be considered as agreeing to the Terms.

II. Definitions
• Customer: "Customer," "You," or "Your" refers to anyone using the services. A customer is someone who uses the services to share, display, upload, or manage information, photos, or reviews, including people managing a restaurant page.
• Content: "Content" means things like reviews, photos, videos, location data, and other information. "Your Content" or "Customer Content" refers to anything you upload or share, such as reviews, photos, or messages. "Khanawale Content" refers to content created by Khanawale, like the website design, software, ratings, and other materials related to the services.
"Third Party Content" refers to content from others, like restaurant partners, available on the services.
• Restaurant(s): "Restaurant" means the restaurants listed on the Khanawale Platform.

III. Eligibility to Access the Services
1. You confirm that you are at least 18 years old and fully capable of understanding and agreeing to the terms and conditions outlined in these Terms.
2. Legal Compliance. You agree to abide by all applicable laws in your country of residence when using the Services. You will use the Services in accordance with these Terms and the law, ensuring that you do not infringe on the legal rights of others or us.

IV. Modifications to the Terms
Khanawale reserves the right to modify or update these Terms at any time. It is your responsibility to review the Terms periodically to ensure that you remain in compliance. Continued use of the Khanawale Platform after any such changes indicates your acceptance of the revised Terms.

V. Translations of the Terms
Khanawale may offer translations of these Terms into various languages for your convenience. However, the English version of the Terms is the authoritative version. In case of any discrepancies between the English version and the translated version, the English version will prevail.

VI. Services Provided by Khanawale
1. Khanawale is always working to improve its services. We can change or stop any of our products or services at any time, without notice.
2. We may automatically update the app on your device. You agree to receive these updates, which are part of the service.
3. If Khanawale disables your account, you won’t be able to access your account or its content.
4. We may set limits on how much you can send or receive through our services in the future.
5. Khanawale may run tests to improve the platform. Some users might see different features at different times.
6. By using Khanawale, you agree to:
The content is for informational purposes only, and we’re not responsible for outdated information. We can update or change the content anytime.
Certifications shown on restaurant pages are for informational purposes and may not be fully accurate. Khanawale isn’t responsible for them.
7. Khanawale may charge a fee for products, services, or orders in the future.
8. We may offer referral or incentive programs. By joining, you agree to the rules of the program and Khanawale. We can cancel or suspend your account if you break the rules.
9. Khanawale may offer promo codes, credits, or cashback, and we can change or cancel them at any time.

VII. Using the Services
1. Khanawale Customer Account and 'Claim Your Business Listing'
a. You need to create an account to use some features, like 'claim your business listing.' We use your personal information as stated in our Privacy Policy. Keep your password safe, and you are responsible for all activities in your account.
b. You can also sign up using your social media accounts (like Facebook). By doing this, you confirm you own the account and let us collect the information allowed by your settings.
c. When creating an account or claiming a business listing, you promise the information is correct. If claiming a business, you confirm you own or represent the business. You can't impersonate others or use false information. False claims may cause financial damage, and you could be held responsible.
d. You are responsible for anything happening on your account. Let us know right away if someone uses your account without permission. Don’t allow others to use your account, or you’ll be responsible for any unauthorized actions.
e. By creating an account, you agree to get messages from Khanawale, like comments from other users. You can adjust your preferences in the account settings.
2. Other Terms
a. We provide phone services to connect you with restaurants. We record calls for billing and customer service. If you don’t want calls recorded, don’t use this service. By using it, you agree to the recordings.
b. You agree to use the Services only for legal and allowed purposes, following our Terms and laws.
c. You can use Khanawale’s data only for personal use, not for business purposes, unless we give written permission.
d. Don’t try to access the Services in any way other than through the official platform unless we allow it. Don’t use automated tools (like scripts or crawlers) to access it.
e. Don’t interfere with the Services or their servers. Don’t delete or change other people’s posts, and don’t send spam (unsolicited messages).
VIII. Content
1. Ownership of Khanawale Content and Rights
a. We own all the rights to the Services and the content on them, like copyrights, trademarks, and logos. The Services are original and took a lot of time and effort to create. Some of the information might be confidential, and you can’t share it without our permission. b. You agree to respect our rights and not use our trademarks or brand names without asking us first. c. You can’t misuse our trademarks or content, like changing them or removing copyright notices. If you do, we may take legal action. d. We don’t promise that using the Services won’t break other people’s rights. If you find out it does, let us know right away.
2. Your License to Use Khanawale Content
a. We give you permission to use the Services only for personal, non-commercial purposes. You can’t copy, share, or change the content unless we say you can. b. If you break these rules, we may stop you from using the Services and take legal action if needed.
3. Khanawale’s License to Your Content
a. When you share content with Khanawale, you let us use it forever, for free, anywhere in the world. We can change, show, share, or make new work based on it. b. If you're a business (like a restaurant), you also allow us to use your content as described.
4. Your Responsibility for Your Content
a. You are in charge of your content. You promise that you own it or have permission to share it. It can’t break any laws or someone else’s rights. b. If you write a review, it must be your honest opinion based on your real experience. c. You are responsible for your content’s truthfulness. Khanawale is not responsible for any problems caused by your or other people’s content.
5. Content Removal
We can remove or block content we think is harmful or against the rules, without telling you. We don’t have to give your content back. Restaurants can also delete pictures from their pages.
6. Third-Party Content and Links
a. Some content may link to other services, like food delivery or reservation websites. If you use them, their rules apply.
b. We don’t control third-party content and are not responsible for it.
c. We may update content on the Services, but we aren’t responsible for any delays or mistakes.
d. Content from third parties (like customer reviews) reflects their opinions, not ours. We’re not responsible for any issues caused by third-party content.
7. Customer Reviews
a. Customer reviews are just the opinions of customers, not Khanawale. We just help customers and restaurant owners communicate.
b. If a restaurant thinks a review is wrong, they can respond to the reviewer. If necessary, we may remove the review.

You confirm that you have read, understood, and agreed to our Privacy Policy. Please note that we may share your information with others, including government authorities, if we believe it's necessary to:
• Address suspected illegal activities
• Follow our Terms and Privacy Policy
• Respond to legal requests like warrants or subpoenas
• Protect our rights or those of our customers, partners, or the public.

X. Restrictions on Use
1. You agree not to:
• Break our rules or guidelines.
• Post harmful, offensive, or illegal content.
• Write fake reviews or reviews that don’t relate to the business.
• Post content that is inappropriate or not in line with the service’s purpose.
• Violate other people’s rights like privacy or copyrights.
• Accuse others of illegal actions or describe fights.
• Report health violations unless required by law.
• Break any laws.
• Pretend to be someone else.
• Hide your identity or location.
• Advertise or cause conflicts of interest.
• Post spam, paid reviews, or other commercial content.
• Claim our content is sponsored unless it’s true.
• Post in a language other than English, unless it’s relevant.
• Mislead others about your relationship with them.
• Access other people’s accounts without permission.
• Spread harmful files or viruses.
• Interfere with the service’s functions.
• Hack or access private information without permission.
• Break confidentiality agreements.
• Try to reverse-engineer or change the service’s code.
• Disable or damage security features.
• Ignore rules to prevent access to the service.
• Collect personal information about others.
• Use bots to post content.
• Harm children.
• Post content that threatens a country’s security or public safety.
• Use our content or services for business purposes without permission.
• Try to do any of the above.
• Post misleading or harmful content to hurt others.
2. We don’t have to watch your use of the service, but we can check your content to improve the service, stop fraud, and follow the law.
3. You agree to use the service legally and not post unwanted ads or break any laws.
4. You agree to be polite when talking on the platform. Using rude language may result in your account being blocked.
5. Your content must follow the laws of your country. If you break any rules, we can block you or remove your content, and you may face legal actions.

XI. Customer Feedback
1. If you share any ideas, suggestions, changes, or documents related to Khanawale's business ("Feedback"), you agree that:
Your Feedback doesn’t include confidential or proprietary information from others.
Khanawale is not required to keep your Feedback confidential and can use it freely.
Khanawale might have already received similar Feedback or be working on something similar.
By sharing Feedback, you give Khanawale the right to use, change, share, and license it globally without paying you or restricting how it’s used. You also agree not to make any claims related to your Feedback.
2. Please only share specific Feedback on Khanawale’s current products or marketing strategies. Don’t send ideas that Khanawale’s policies do not allow.
3. Khanawale and its employees do not accept unsolicited ideas, such as ideas for advertising, new products, or marketing plans. Please do not send any unsolicited suggestions, artwork, or ideas.
4. This policy is meant to prevent misunderstandings if Khanawale’s products or strategies seem similar to your ideas. If you send us your ideas despite our request not to, the following rules will apply:
5. Terms for Idea Submission
You agree that:
Any ideas or materials you submit automatically become Khanawale’s property, with no compensation to you.
Khanawale can use or share your ideas in any way, for any purpose.
Khanawale is not required to review your submission.
Khanawale has no obligation to keep your submission private.

XII. Advertising
1. Some Services are supported by ads, which may be targeted based on your activity or the content you view. The way Khanawale displays ads may change without notice. By using the Services, you agree to the presence of such ads.
2. Some parts of the site may contain ads, promotional content, or materials provided by third parties. The responsibility for ensuring these materials comply with laws lies with the third party providing them. Any interaction or transactions with advertisers on Khanawale are between you and the advertiser. Khanawale is not responsible for any issues that arise from these interactions, including errors or damages.
3. If a charitable campaign is advertised on Khanawale, and it involves donations through third-party websites or bank accounts, Khanawale is not involved in handling the funds. We do not take responsibility for the accuracy or legality of the campaign information. We encourage you to verify any details before donating.

XIII. Additional Terms and Conditions for Customers using Khanawale services:
1. Food Ordering and Delivery:
a. Khanawale provides food ordering and delivery by working with restaurant partners ("Restaurant Partners") and stores ("Stores"). These partners list their menu items for customers to order and receive via the Khanawale Platform.
b. Customers can browse the available food items on the Khanawale Platform and place orders with Restaurant Partners/Stores through the platform.
c. When you order food or products, you are giving Khanawale permission to place the order with the Restaurant Partner or Store on your behalf.
d. Your order may be delivered by the Restaurant Partner, the Store, or a third-party delivery service ("Delivery Partner"). Khanawale connects you to these partners but does not handle delivery directly.
e. Khanawale is not responsible for any delivery-related issues, such as delays, wrong deliveries, or damaged items.
f. Orders may be grouped with other customers’ orders to streamline delivery.
g. You may need to pay a delivery fee, which can vary based on factors like distance and order value. Khanawale will inform you of the delivery fee, but you are responsible for paying it.
h. In addition to the delivery fee, there might be extra charges based on factors like demand or weather conditions ("Delivery Surge"). Khanawale can collect this fee on behalf of the partners.
i. Khanawale will provide you with order documents, such as invoices, as required by law.
j. You should treat Delivery Partners with respect and avoid discrimination or harassment of any kind.

2. Food Ordering and Delivery with Restaurant Partners:
a. Prices for food items are set by the Restaurant Partner and displayed on the platform. If there’s a price difference between what’s shown on the platform and the final charge, the Restaurant Partner’s price will apply, except for delivery fees.
b. Some orders may have an "On-Time Guarantee." If your order is late, you may be eligible for a discount coupon, subject to certain conditions. This guarantee does not apply in cases of unforeseen delays.
c. Khanawale Gold: Customers who are members of Khanawale Gold can receive discounts from participating restaurant partners for home delivery.
d. Gift Orders: You can send food as a gift to someone else. You’ll need to provide the recipient’s contact details and get their consent for sharing this information. Any issues with the gift order will be handled through you.
e. Order Deletion: If you delete an order from the platform, it will be removed from your order history, but Khanawale may still retain records as per its privacy policy.
f. On-Time Delivery: Some orders may be eligible for an "On-Time Delivery" guarantee. If your order is delayed, you could receive a coupon, but this does not apply in cases of unforeseen delays.

3. BOOK SERVICE/TABLE RESERVATIONS:
a. Booking a Table:
You can book a table through the Khanawale platform or app. Your booking will be confirmed by email or SMS after the restaurant accepts it. You need to give correct details, and by booking, you agree to Khanawale’s rules and privacy policy. You also agree not to book more than one table per mealtime.
b. Booking Fees:
Khanawale may charge a fee for booking, which the restaurant will subtract from your bill. You’ll still need to pay the remaining amount and any extra charges or taxes. If the fee changes after you pay, the amount you paid will stay the same. You may need to show the payment method at the restaurant.
c. Changes and Cancellations:
If you want to change your booking, the restaurant must agree.
If there’s no booking fee, you can cancel up to 30 minutes before.
If you’ve paid a fee, you must cancel 24 hours before to get a refund.
If you cancel later, you may not get your fee back.
Refunds are processed in 7 working days.

d. Late Arrivals:
Please arrive 10 minutes early.
If you’re late, the restaurant may cancel your booking.
Khanawale is not responsible if this happens.
If you’re more than 10 minutes late or don’t show up, you won’t get a refund.

e. Disputes:
If there’s a problem with your booking, contact Khanawale within 30 minutes.
We’ll try to solve it and may offer a refund at our discretion.

f. Personal Information:
You’ll need to give your name, phone number, and email to book a table.
Khanawale will share this information with the restaurant to confirm your booking.
Khanawale is not responsible for how the restaurant uses your information.

g. Special Requests:
If you have special requests, Khanawale will send them to the restaurant.
It’s the restaurant’s job to fulfill them, and Khanawale is not responsible if they don’t.

h. Call Recording:
Khanawale may contact you by phone, SMS, or email about your booking.
Calls may be recorded for training purposes.

i. Limited Responsibility:
Khanawale connects you with the restaurant.
We’re not responsible for your experience there, such as the service or food quality, or if the restaurant doesn’t keep your booking.

5. FOOD HYGIENE RATINGS:

a. What Are Food Hygiene Ratings?
Food Hygiene Ratings are checks done by trained auditors to see how clean a restaurant is.
Khanawale only helps arrange the checks but doesn’t do them itself.

b. What Do Hygiene Ratings Mean?
The Hygiene Ratings shown on the Khanawale platform only show how clean a restaurant was at the time of the last check.
They do not show how good the food is.

c. How Long Are the Ratings Valid?
i. The Hygiene Rating will be valid for either 6 or 12 months, depending on when the last check was done.
ii. Khanawale can remove the rating once it expires, without letting you know.

d. Disclaimer and Liability:
i. The Hygiene Ratings are based on the information given by the auditors.
Khanawale doesn’t guarantee the accuracy of the ratings.
ii. If you decide to trust the Hygiene Ratings, you do so at your own risk.
Khanawale is not responsible for any problems that happen because of it.
iii. Khanawale is not responsible if the restaurant doesn’t show the correct rating on its site or in the restaurant.

e. Limits of Hygiene Ratings:
The Hygiene Rating is not proof of how clean the restaurant is all the time.
It can’t be used as evidence in court or any legal issues.
The restaurant is responsible for keeping its hygiene up to date.

7. DELIVERY OFFER / PLAN:

a. The Delivery Offer is a limited-time, invite-only deal that gives you discounted delivery on your next few orders ("Offer").
To use it, choose the Offer when placing an order on Khanawale and pay an extra amount to claim it ("Claim Order").
After your Claim Order is confirmed, you can use the Offer on future orders that meet the conditions below.

b. If you use the Offer, these rules apply:
i. You’ll get a discount on delivery, including extra fees, for future eligible orders, as shown on the Khanawale platform.
ii. The Offer gives you a limited number of discounted deliveries ("Count"), which will be shown when you claim the Offer.
iii. When the Count is used up, the Offer will end.
iv. The Offer lasts for a limited time, shown when you claim it ("Offer Period").
Once the time is up, the Offer will expire.
v. The Offer is only available in India and in cities where you can place delivery orders on Khanawale.
vi. The Offer is only for paid online delivery orders, not for take-away, dine-in, or grocery orders.
vii. The Offer works with all restaurants.
viii. The Offer may only apply to orders with a minimum value, which will be shown when you claim it.
ix. The Offer doesn’t work for inter-city orders or other services, as shown on the Khanawale platform.
x. The Offer can’t be exchanged for cash or anything else.
xi. Once you claim the Offer, it automatically applies to future eligible orders during the Offer Period.
You can’t remove it from certain orders.
xii. No refunds or compensation after you claim the Offer.
xiii. The Offer can’t be transferred or refunded.
If you cancel the order, the Offer will also be cancelled.
Any refunds will follow Khanawale’s rules.
xiv. Khanawale can block your device or cancel the Offer if these rules are broken or if there’s suspicious activity.
xv. Khanawale can change, extend, or cancel the Offer at any time and will let you know.
Updates will be shown on the Khanawale platform.

XIV. Warranties, Liability, and Indemnity
1. Warranties The services are provided "as is," and you use them at your own risk.
Khanawale doesn't promise the services will always work perfectly, be error-free, or be safe from viruses or bugs.
They’re not responsible for any harm, damage, or loss caused while using the services, including loss of data.
You are responsible for anything you download or any issues that happen because of your use.

2. Liability Khanawale is not responsible for any damage, loss, or problems you have while using the services, including mistakes in content, data loss, or any harm caused by using the services.
This includes indirect issues like loss of profit or damage to your reputation.

3. Indemnity You agree to protect Khanawale from any claims or damages caused by your actions.
This includes using the services incorrectly, violating someone’s rights, or breaking the rules.
You can't settle any claim without Khanawale's approval, and they may defend the claim at your cost.

XV. Ending Your Access to the Services
1. You can delete your account anytime by contacting us through the "Contact Us" link or by going to Profile > Settings > Security > click 'Delete Account' and stop using the Services.
2. We can stop your access to the Services for any reason, including if you: (i) break these rules, or (ii) stop using the Services. We don’t have to warn you first. We can also delete your account and all your information right away. If you break the rules, we might keep any data from your use of the Services. We are not responsible if you lose access to the Services.

XVI. General Terms
1. Interpretation: The section titles are just for reference and shouldn't be used to explain the Terms.
2. Entire Agreement and Waiver: These Terms, along with the 'Privacy Policy' and 'Guidelines and Policies', make up the full agreement between you and us. If we don’t use a right or rule right away, it doesn’t mean we’ve given it up. Also, using a right once doesn't stop us from using it again.
3. Severability: If any part of these Terms is found to be illegal or unenforceable, it will be removed, but the rest of the Terms will still apply.
4. Partnership or Agency: These Terms don’t make us partners or give you the right to represent Khanawale in any way.
5. Governing Law/Waiver:
(a) For customers in India: These Terms follow Indian law, and any disputes will be handled in New Delhi courts.
(b) For all customers: If you have a legal issue with us, you must take action within one (1) year of the event. After that, you can’t make a claim.
6. Carrier Rates May Apply: You may be charged by your phone or internet provider for using the Services. Check with them to avoid surprise charges, as you are responsible for these costs.
7. Linking and Framing: You can link to the Services, but you can't connect to any inappropriate, offensive, or illegal websites. If you break this rule, we can stop you from using the Services.

XVII. Copyright Infringement Notice
Khanawale is not responsible for copyright violations caused by users or other third parties on our platform. We respect copyright laws and expect users to do the same. If needed, we may remove or block content that violates copyrights. We can also remove links to infringing material. If a user repeatedly violates copyright laws, we may stop their access to our services.
If you believe your copyright is being violated, follow these steps to file a notice:
1. Describe the copyrighted material you claim is being violated.
2. Provide details about the content on our platform that is violating your copyright, including information like the username or business listing.
3. Include this statement: "I believe in good faith that the use of this material is not authorized by the copyright owner, their agent, or the law."
4. Include this statement: "I swear the information provided is true, and I am the copyright owner or authorized to act on their behalf."
5. Share your contact details (address, phone number, and email if available).
6. Include your signature (physical or electronic).

Be aware, you may be held responsible if you make false claims in a takedown notice.

• If you have an issue with your order, you can first contact us through chat support on the Khanawale app for quick help.
• You can also email us at order@Khanawale.com, and we will try to resolve your issue as quickly as possible.
• After emailing us, you will get a ticket number to track your complaint.
• If you're not satisfied with the response, you can escalate the issue to our Grievance Officer by sharing the ticket number. We will try to resolve your issue within 48 hours.
